The National Security Act (NSA), 1980, allows for the preventive detention of individuals to prevent them from acting in any manner prejudicial to the security of the State or the maintenance of public order.
The Assam government invoked the NSA against activist Pranab Doley following his involvement in protests against a luxury hotel project near Kaziranga National Park.
The detention order cited 13 police cases registered against the activist since 2017, alleging involvement in road blockades, damage to public property, and receipt of foreign funding.
A local court had previously granted bail to the activist, noting that the standard apparatus of criminal law should not be used to suppress local anxieties regarding ecological preservation and indigenous survival.
The judiciary observed that the protests were rooted in concerns over environmental degradation and its impact on the socio-cultural fabric of local communities, specifically tea tribes.
The court found no evidence of 'deadly weapons' and noted that the activist's foreign visits and funding were not hidden.
