Gauhati High Court order on deportation compensation

The Gauhati High Court ordered the Assam government to pay ₹2 lakh as interim compensation to the husband of a woman who was deported to Bangladesh.
The court found that the woman was deported without being given an opportunity to challenge the order of the Foreigners Tribunal (FT).
The court observed 'malice in law' in the handling of the case by the Nagaon Foreigners Tribunal.
The deportation was ruled a direct violation of the standard operating procedure (SOP) governing the expulsion of declared foreign nationals.
The court noted that the state prevented the individual from exercising her legal right to approach the High Court against the FT order.
The compensation is interim and does not preclude the petitioner from seeking further damages in a civil court.
The Ministry of External Affairs has been impleaded and advised to locate the woman in Bangladesh and facilitate her repatriation to India.
