Citizenship Amendment Act (CAA) implementation by District Collectors

  • The Union Ministry of Home Affairs (MHA) has transferred the processing of citizenship applications under the Citizenship Amendment Act (CAA), 2019, from Empowered Committees to District Collectors in eight specific States and Union Territories.
  • The affected jurisdictions include Gujarat, Rajasthan, Punjab, West Bengal, Assam (excluding tribal areas), Tripura (excluding tribal areas), Jammu and Kashmir, and Ladakh.

  • Citizenship is a subject under the Union List of the Indian Constitution.
  • The Citizenship (Third Amendment) Rules, 2026, empower District Collectors to receive, scrutinise, and dispose of applications for registration or naturalisation under Section 6B of the Citizenship Act.
  • Collectors are responsible for verifying applicant documents and determining eligibility based on the criteria for non-Muslim communities from Pakistan, Afghanistan, and Bangladesh who entered India before December 31, 2014.
  • The order effectively makes the March 11, 2024, MHA notification regarding the processing of these applications inapplicable to the specified jurisdictions.
